I've got a photo but not sure how it'll go on so will try and say what it is.
Behind the back bumper on the E61 there's round or oblong metal crash type looking thing. I think it's part of an impact bar or something. The thing is one side's rusted through with a hole in it, the other side is the same bit no hole (yet!). Now I thought this would be part of the back structure of the bumper hence I think it would be a fail but its not, not even an advisory. I know my explanation is probably vague or maybe somebody know the bit I mean. I'll try and get the photo on though.

Post a picture lol. I assume on the E61 its the same as I have an E60 but thats the crash bar. An MOT tester wouldn't be able to check it or see if there is one there unless they remove the bumper which they would never do. Try posting it on IMGUR.com and sharing it on here.

That's where you're wrong, you can see it, if I can see it from underneath without looking hard so can they. I'm used to putting photos on grim the phone not from an image thing.

Try looking in the testers manual.
It may give you the answer you are looking for as without a picture it is very hard to judge.

Are you sure that it is not a solid weight? The Z3 has one such cast iron weight on each side of the rear bumper, mounted on rubber bushes. According to BMW this gives the car a greater feeling of solidarity when cornering, by damping out vibrations.
